General terms and conditions 

 

VILLA TROPICANA

 

1. subject of mediation

Villa Tropicana rents out vacation apartments and hotel rooms as well as other services in its own name. The following terms and conditions apply to short and long term rentals.

 

2. conclusion of contract

A contract with Villa Tropicana is concluded by accepting the booking with the customer/guest.

 

3. accommodation services

 

3.1 Booking

 Villa Tropicana offers overnight accommodations in its own name via its reservation system. The information given in the media of

Villa Tropicana are based on its own information and are prepared to the best of its knowledge and belief. Offers are generally only valid if they are still available at the time of the customer request "offer while stocks last". 

Villa Tropicana checks if the room requested by the guest is available at the requested time. The accommodation contract is concluded as soon as the booking has been confirmed by Villa Tropicana (by e-mail, written booking, telephone booking). Any deviating arrangement must be made in writing. Villa Tropicana is obliged to provide the reserved accommodation for the booked period or to offer a suitable comparable accommodation as a substitute. The guest is obliged to pay the agreed price for the duration of the contract.

3.2 Payment

The customer shall pay the total amount plus any incidental expenses, for the booked apartment to 

Villa Tropicana in advance, otherwise after prior written agreement. 

3.3 Prices

The prices in the media are invalidated by new offers. The indicated gross prices are valid with the exception of trade fair periods and special price periods. (New Year's Eve, marathon, ITB, trade fairs, etc.) For inquiries and bookings for which the standard prices are not valid, the interested party will be informed of this before the booking. In the case of a booking that has been made, the prices at the time of the inquiry shall apply. The equipment elements indicated and shown in the media are approximate values. In individual cases, the equipment may have changed.

3.4 Arrival or departure

Arrival is possible from 3 pm. Departure is possible until 10 a.m. Other arrival and departure wishes please communicate in advance. 

3.5 Deviations

A deviation of the arrival modalities is possible in principle, however, requires the written form.

3.6 Withdrawal from the contract/cancellation

The guest can withdraw from the contract at any time before the start of the trip by informing 

Villa Tropicana of the contract. The withdrawal has to be declared in written form (not by email but by fax or letter post). Cancellations are free of charge, regardless of the date of booking, as long as they are received in writing by Villa Tropicana at least four weeks before the booked date of arrival. Exceptions will be agreed upon in writing by the service provider directly with the guest immediately after receipt of the reservation confirmation.

 

If a reservation is cancelled by the guest less than 60 days prior to arrival, Villa Tropicana will try to find another accommodation for the vacated apartment(s). If the guest does not succeed in finding another accommodation, Villa Tropicana is entitled to claim damages for non-fulfillment according to § 651 BGB (German Civil Code). The cancellation conditions of 

Villa Tropicana are as follows:

 

The cancellation fees charged for no-shows are as follows, according to the price of the overnight stay in EURO:

 

up to 60 days 0 % 

 from 48 days 30 

from 30 days 70 

from 20 days 100

The individual early booking discounts will be charged with 100% cancellation fee in case of cancellation.

 

Villa Tropicana is at liberty to claim further damages for non-fulfillment from the guest if it can be proven that the rooms that became vacant due to the cancellation could not be found elsewhere.

3.7 Villa Tropicana reserves the right to cancel bookings due to non-fulfillment of payments.

4. liability

Villa Tropicana is only liable for the rental activity. Liability is limited to intent and gross negligence. Liability for simple negligence is excluded. Villa Tropicana is not liable for disruptions due to force majeure or strikes or transmission failures in the communication network.

4.1 Defects of the rental object have to be reported to Villa Tropicana immediately. Defects are to be reported immediately upon arrival.

5. registration of claims and statute of limitations

Claims due to non-contractual performance of the services are to be addressed immediately and exclusively to Villa Tropicana. Claims become time-barred 6 months after the services have been rendered.

6. data protection

Villa Tropicana is allowed to collect, process and use personal data of its guests as far as the data is necessary to establish or change the required processes including their content (inventory data). Booking data is collected, processed and used by Villa Tropicana in accordance with the legal regulations. The storage and transmission of all booking data will only take place as far as this is desired and/or necessary. The guest agrees to receive information related to Villa Tropicana by e-mail or mail in order to ensure a comprehensive standard of information.

7. general

The ineffectiveness of individual provisions of the rental conditions does not result in the ineffectiveness of the entire rental conditions. If the customer is a fully qualified merchant, a legal entity under public law or a special fund under public law and if the order is part of the operation of his commercial business, the place of jurisdiction shall be Berlin. Exclusive places of jurisdiction remain unaffected. The business relations between the guest and Villa Tropicana are exclusively subject to the laws of the Federal Republic of Germany for domestic contracting parties. The UN Convention on Contracts for the International Sale of Goods shall not apply. Subsidiary agreements have not been made. Such require the written form. These terms and conditions apply to rental services provided by

Villa Tropicana.

8. place of jurisdiction local court Potsdam

The place of jurisdiction for all disputes arising from the accommodation contract is, in accordance with the statutory provisions of the state of Brandenburg in which Villa Tropicana is located; the place of jurisdiction is therefore always a local court in the state of Brandenburg.
